You might want to read the rules again. It's part of the Marmion Marine park which ends northwise at Burns Beach.

Throw netting is not allowed. 

Go wild at Mindarie's though!

and that is that the wording to which you refer is contained within the Net Fishing Recreational Fishing Guide. Confusing I know, but this is a guide only and its wording is inconsistent with the wording contained within the Fish Resources Management Act and the Fish Resources Management Regulations. I sought clarification from the Fisheries Dept on this matter and received the following response:

"In response to your query regarding if it is legal to use a cast net in the local Harbours inside the Marmion Marine Park being Hillarys and Ocean Reef.

Fisheries Officers are bound by the legislation that they are appointed to under the Fish Resources Management Act and Marine Safety Act.

From a Fisheries perspective as long a person is the holder of a current Recreational Net Fishing Licence and they are using a net that is lawful under that licence then, yes it is legal from a Fisheries perspective to net fish in the Harbours.

From a Marine Safety perspective as long as the fishing activities is not impeding on vessels or causing a safety risk to any person/vessels. There is no offence.

The harbours are not part of the Marine Park.

There may be other legislation that would have to be considered, such as Local Council Bi-laws or Harbour Management Rules. Those entities may have enforceable offences in place that don’t allow the act of net fishing in Harbours or certain areas."

 Mindarie is ok as stated above, However it is private property and sometimes security ask you to cease netting and leave. If you dont leave , you are now tresspassing and can be charged. 

They normally do this when people are making a mess, or bothering others in the area. 

I have been moved on a few times, usualy after they have had theft problems from the boat pens, or properties.
