Crabbing Scenario

4 persons go to mandurah in the same vehicle .. two go in the boat and get their 20 the other two scoop landbased and get their 20 . All legit , but once we are ready to go fisheries decide to knock on the window and check with 40 crabs in the esky , yet 20 is the max on a boat. The onus would be on us to prove we caught them separately if the officer decided we might be telling porky pies for some reason . Obviously to eliminate any drama is to take two cars , but not really wanting to . Might be overthinking it , but not wanting to chance a hefty fine if this scenario did eventuate .
Any thoughts ?

yet another grey area in our fisheries guideline. You have done nothing wrong so fair to argue it the whole way, no way to prove it either way

im sure scoop nets, floating
im sure scoop nets, floating boxes, wet shoes and so on used for scooping will be enough to prove they were caught scooping. You could also say that from the boat you were not getting many so ended up walking for them.
If you dropped 2 off from the boat in the shallows and they got their 20 and you got 20 netting and get checked at the remp, your screwed.

I would say it's all to do with posession. Isn't it like having more than the allowable limit of fish or crays at a residence? I wouldn't be testing the theory out.

Normaly fisheries would check
Normaly fisheries would check you at the ramp, if you took your mates out on the boat and dropped them off some where to scoop, picked them up on the way in, you would be screwed.
If you dropped them of in the car, then went crabbing in the boat, put the boat back on the trailer then picked them up. I dont think they could ping you.

The boat limit would not apply...
The boat limit (boat possesion limit) would not apply as you catch has already been landed. If you had 40 crabs and 4 blokes you are within the bag limits.
From the regs:
3A) For the purposes of section 51(1) of the Act, the maximum quantity of fish of the species referred to in this subregulation that a person on a boat may be in possession of, whether the fish is on or attached to the boat or any tender or other vessel operating with or attached to the boat, is —
(a) if there is only one person on the boat —
(i) one day’s bag limit of blue manna crabs; and ...(b) if there are 2 persons on the boat —
(i) 2 days’ bag limit of blue manna crabs; and

The key words fo me are: "on a boat", which doesnt apply if you are in your car.

2 hr round trip for us..
2 hr round trip for us.. hence 1 car ideally .. Wouldn't drop or pickup via boat that'd be pushing it.. Could get imaginative retrieve boat , unhook trailer around the corner , text mates for covert rendezvous point , my wingman with binos casing it out , then swoop in pick them up , hand the balaclavas out then get the trailer .. It's a pity to have to think of ways around possible litigation when there's no intent .. I suppose I could always tell them to catch the train back with their catch lol .. Gonna have to be two cars by the sounds of it , to be sure to be sure .

Just dont carry the full 40 in the boat on the way back. Carry 20 in the car.
Also if stopped point them to this site and show them the question you asked. It is legal what you are doing.
But I hope not to put a damper on it all, but I think you might be battling to get 40.
Been out for 60 pulls (10 x 6runs) for NADA the other day. Plenty off crabs, but not ONE legal. Spoke to a neighbour that are retired in Parkridge(Bouvard) that go out often and yesterday he got 4 after giving it a good bash. His mates got 3 and another 6. These salts know the Dawesville south estuary like the back off their hands and advised that it is "just" a little to early. They all got plenty off undersize ones though. No news on scooping.
But then I dont care as a day on the water is better than nothing, so trying again this weekend, and inbetween runs popping the flats.

Between 4 guys who may each have a family or other friends who like crabs that certainly isn't a lot!
If I came home with my limit of 10 crabs is be lucky to get 1 to myself after sharing them with family.

Same thing Goodz, i rarely get my fill after every one else hops into them. 10 crabs per fisher is not alot IMO, i could eat that many myself in one sitting, unless they were those big blues you get in the Swan, then i struggle to finish of three .
