Maximum people allowed on a vessel

Hi,
The builders plate on my boat states that I am allowed 5 people = 375kg.
Does this mean I can legally put 6 people on the vessel if the combined weight is less than 375kg if I have enough life jackets etc?
And if I put more on will I get fined and how much?
Not going offshore or doing anything stupid was just thinking of taking a few people out in the estuary and canals in Mandurah to look at the Christmas lights.

Its a recommended figure, but if you are over the number or weight and something goes pearshaped you may find yourself in deep shirt.

I would take it as 375kg max weight including persons and gear eskys etc ..

As Carnarvonite said. It is the maximum number/weight that your vessel is engineered to take and remain stable within set limits based on an Australian standard.
It is not referenced in any legislation, so no fines can be issued, but if things went wrong and you found yourself in court, then failing to comply with the standards would go against you.

Then
Why can you be fined if you have a spotter and are towing 2 people on a tube, with a three man ski? (thats 4) I was told in no uncertain terms that it is illegal to have more that the specified limit. I have a three man ski and I can only pull 1 person on a tube as I have to have a spotter.
