Dont touch your phone in the car! -just got nabbed (and no was not using the phone)
Tip for fellow Fishwreckers..
Picked up 250 fine today for touching (not answering) my mobile- thought it was worth sharing as the rules have changed and if it saves someone else a few bucks then i will feel better!
Was at the lights stuck in CBD traffic - lights changed to red - I was stopped and my phone was in the centre console drinks holder - i picked it up to lock it (blackberry and often if bumped will pocket call someone) put it back in console - lights still red, car still stopped - knock on the window from a Cop on a bike - he explained to me that you are not allowed to touch your phone at all when driving - 250 bucks and a fairly decent argument later i was on my way (now late) to a meeting.
guys in the office have found out and i am now friday fodder :-(
cheers

thats tough
lot of accidents and deaths are caused by phone users, hard for them to draw a line in your case, if you are on the phone your gone as far as I'm concerned, cop was on the other day and you can't take photos either

yeah i am all for safety and can understand their stance - i though the rule was you could not use the phone whilst driving - ie answer calls or text or otherwise - i was stationery and touched the button on top - cant see how that is different/worse that picking up and putting back a coffee cup (in the car) but i guess they are trying to make a point - easy way to do that is slug people - word spreads pretty quick- its Friday, i am still happy :-)

Must have been a slow day for him .. you would think a bit of discretion would come into play . Texting and driving is a worry and thats primarily what they should be targeting . Anyway did you film and abuse him then upload it to youtube ?

haha
no mate - work phone so would be in trouble on two fronts there!
I suspect he was having a bad day gave as me a fairbit of stick for...as i pointed out - "pushing a button on top of my phone", there was no upside to me pushing the issue so thanked him for the fine and wished him a good weekend. That seemed to not sit well with him, either made him angrier or realise he had possibly been a little harsh!

Criminals
Nice to know they have run out of criminals and 18 yo chicks who pull out in front of you while on the phone with one hand and flipping the bird with the other to hassle.
I feel a lot safer. Now if they could only get those pesky J walkers....

" fxxxxxx smart arse I am booking you and you can breath into this as well"

Couldav given you a warning.
Couldav given you a warning. This is news to me so thanks for the heads up, who knows what the rules are these days....Given the circumstances, a warning would have been suitable I think, its no wonder people have a bad attitude against cops. He musta been the kid that got his play lunch stolen off him at school lol

itd be a pretty rare person
itd be a pretty rare person who could be 100% certain they arent breaking the law in some way at some time, whether driving fishing etc.
And that is just the way the Government and Police likes it to be.
They like to be able to find something if they want to, when they want to.

Same thing happened to me!
Bluetooth handsfree kit decided to crap itself while on a business call, reached down to phone to turn on speaker phone (while at a set of red traffic lights) and continued the call via speaker phone. Didn't think anything of it until the flashing lights behind me beckoned me to pull over. Policeman asked if I knew why he pulled me over (of course my stupid sense of humor nearly got the best of me by thinking that I wasn't speeding fast enough to get away!) to which I replied NO to be told they saw me touching my phone and did I have a valid reason for it? As I was explaining what had happened my handsfree kit decides to pipe up and start continually saying "NO PHONE FOUND!!!!!". As this occurred I told the kind gentleman that there was my proof! He explained that he could understand what had happened but he would have to book me anyway! Nice chap really (NOT!) 250 dollars after and 3 demerit points I have learned my lesson and don't touch the bloody thing and installed a bluetooth capable stereo in the work vehicle.
Worst part about the whole thing was telling she who must be obeyed when I got home from work! Oh well back up S*&T Creak again! hahahah

not news to me
I learned the hard way, if it's not in a cradle you cant touch it, at the end of the day it's the law..live with it, if they let off evryone who said they wernt using it just looking at it (reading a text is using it) they would never catch anybody, I do it and i've lost cocentration a couple of times espescially with a smart phone touch screen the old type I could do it without looking at it at all realy but if I get caught It's my fault and wont be pissed off at the cops for doing their jobs I'll be pissed at myself for getting caught'

Sooooo . . . . . . if the
Sooooo . . . . . . if the phone is in a cradle and you press a button, that's OK ?
But if you have bluetooth connected through the stereo but the phone is not in a cradle and you press the button on the IPhone to bring up SIRI to give a voice instruction, that's not OK ?
If thats the case the law is an ass. FFS you can press radio buttons, mobile gps buttons, get a drink, light a smoke and any other number of distractions BUT don't you dare touch that phone if its not in a cradle.
I just have to ask the question . . . . . . can you text on a mobile if its in a cradle ?

Try make a call on it?
Officer saw me touch my 'mobile', pulled me up as I entered the work car park.
'Saw you use your phone'
I handed him my iPod and asked him to make a call on it which was about when he realised (and i pulled my head in). I then pulled my phone out of the hidden compartment complete with cable connecting it to the stereo and told him I don't have to touch my phone as it's controlled through the stereo in the ranger.
My boss wanted to know why the cops had pulled me up in the car park. I told him it was a case of mistaken identity.

then he was wrong
not to give you a ticket because it is also ilegal to also use any mobile device
that has a screen ie: ipod, gps, anything like that if it's not in a cradle
and also ilegal to use the gps even in a cradle whilst moving! ie punching in an address whilst driving, bollocks yes but thats the way it is.

interesting question
you can use a phone in a cradle, you cant use a gps in a cradle or maybe you cant use a phone in gps mode in a cradle'
maybe and I'm not sure you can only answer a call and nothing else on your phone in a cradle maybe it's written somewhere outlining exactly what you can and cant do
