Fisheries WA stop the thieving, again

Yes yes yes, today on Facebook there is a heart warming story of how fisheries have struck again in bringing bloody cray thieves to account.
The story goes on about a certain thief who decided that lifting a pros cray pots, taking the catch that they held, then replacing the pros floats and ropes with his own.
The Fisheries caught up with him near Coventry reef apparently.
For his trouble he (Mr Jason Keith Knowler) now restricted to land based activities was fined $10.000 lost his boat named Red Barron together with the boat trailer plus all the gear associated with the boat was confiscated
As well as being banned for life from holding a rock lobster licence.
Well done Fisheries a bloody great job.
I love a story with a good ending.

Sorry but great as it sounds, I no longer trust that Fisheries is "doing the right thing" after seeing what they are doing to Bret Carter.
Who knows what other shortcuts, cut corners and and other shit goes unchallenged?
As fucked up as it might be, they wouldnt be the first enforcement agency to take the easy way because they "probably did something anyhow".

Agree . I've got 20 tags of pinks this year, some very old ones by the looks of growth on them.Also stopped filling in booklet for them.( reasearch). Bad form. . I use to also keep carcusas for them . No more. Last survey I done asked to many questions at the end( how much money do you make a year. Do you feel you have to bag out every time you go out. Do you enjoy fishing.( really). Is it about fishing or food. I hung up in the end. Myself and boys never again. Done it with me. 90 percent isn't fisheries fault . Its d--k knobs phoning there dob in fisherman number. People who haven't got a life or think they are missing out on something. Only my opionion . Brett's case is another one that gets on my goat . Anyway that's my bitch . But in general they have a job to do , and sometimes do it well . I treat them how they approach me at ramp , some are very rude. Some are brilliant and polite. I wonder if they keep all there footage .

When most were falling over themselves with praise because Fisheries had pinched a few pot lifters, I had the temerity to suggest that it wasn't all good with them, and was taken to task for it. They can be as venal and petty as any government department, and its YOUR money they are using to crush Bret Carter, because when they decide to " make an example" of someone, they can't be seen to lose. Their behaviour in this case has been inexcusable.

The key point to this from what I can see is this Paragraph ,
Fisheries officer Natasha Demir said, in her opinion, a lobster was 'taken' once it was captured underwater and that an assessment of whether it is a protected lobster must be made within five minutes.
I have Dived for crays for years and always throught and was told by fisheries.
1. 5 min started from the time you got back on board the boat.(as told by fisheries officers at Rotto)
2. Thats just her opinion ,dosent make it the law

I wonder if they would have been as hard on this person if it was only a rec fishers pot and not a Pro's pot.

Anyone know what she looks like?
Watching the progress of this from afar I have often wondered whether this chick is physically attractive, or at least presents a kind of feminine vulnerabilty of some sort.
Did he (Carter) act patronisingly towards her in any way? (are there transcripts of the alleged incident anywhere?)
It's such a blatently wrong assessment. On a couple of occassions I have been a approached after diving out of a boat by the authorities concerned, emptying a full bags a crays onto the deck. Clearly in excess of the limits at the time to be told in both instances (once by fisheries, once by the water police) that it wasn't a problem to be doing so and that between myself and the other divers we had five minutes to measure up the catch, take our limit, and return the remainder to the water.
Is there potentially some face saving going on here? The protective older males coming to the rescue of a well intentioned but vulnerable (in the sense that she didn't know her job) younger female?
The case seems so patetently absurd that to me, that the only thing that could concievably drive this kind of stubborness from fisheries in the face of such overwhelming evidence that the case is flawed, is the vehement defense of the ego.

They rang us up asking to speak to my 11yr old daughter to do a survey and when i said shes only 11 and you will be speaking to me not her they would not take no for an answer . I wondered at the time wether it was a survey of sorts or do they actually know the age of the person they are trying to speak to so that they can try gather information and catch people out doing the wrong thing by getting the kids to dob people in without them knowing. Not that we had anything to hide anyway but i dont care who you are from what ever agency you are from you wont be speaking to my kids without me present or my approval first.
We feel nothing but a certain difficulty in continuing to stand

When searching my boat and kids boats. Prob nicest I've met as regards being polite towards people. It's going to be interesting diving this year . They have to keep pursuing other wise others who paid without fighting for there rights would have to be refunded I would imagine?

I recall mention in an earlier post from Bret that this came up in court. The Fisheries view was that divers should be checking their catch underwater for undersize, setose, number taken (8 max.) etc, prior to putting the crays in the catch bag. As Fisheries cannot ascertain exactly when the crays were taken they will allow divers a 5 minute duration after returning to the boat to return to the water any prohibited crays and clip the tails of the keepers. And now the part that imo simply defies any common sense or logic. I am of the view that the original intent of the Regulations was that each diver or potter could take home 8 legal crays. I see this as a no brainer. Fisheries are OK with the diver returning crays to the water within 5 minutes if they are prohibited however they will argue he cannot go back down and get more crays to replace the returned crays as he has already TAKEN 8 under their interpretation. Mind-boggling.

No one can say that in the cold light of day.
If anyone has made that statement that you can't go down and catch more crays to make up your bag limit of 8 then they are well on the way of being certified and need to be taken to Alma street hospital.
