Fishing clubs and 'selling' fish?

There's been some chat up here recently about incorporated fishing clubs and their ability to 'sell' fish. Now if people donate fish to the club, the club can then ask for a donation for the services of cooking (using oil, bbq, staffing) etc. Now I'm not 100% sure if this information is correct, if there's members/presidents of clubs out there, could you please let me know if this is right?

If it is, do you think that its ok?

Im a club President but have never heard of that one. If it is a loophole it would definately be outside the 'vibe' of the law. Got no problems serving up a BBQ with fish wouldnt charge for it.

i personally dont think it should be done. there are people out there that do sell their fish but that is actually against the law.i think even if the fish are donated to a club of some sort and then they cook it off and charging people for a feed it would still be illegal. however if the fish were given to a club and they cook it up and give it to people and they charge for a side salad or whatever that would be ok as they are not selling the fish only the sides

if it's for a fundraiser for the club then it shouldnt be a problem. Especially if they are for one off events. If its going to be something done every weekend then you might need to seek the right approvals.

Would be worth checking with your local council...

Adam - in your experience is there any issue from Dept of Fisheries side with doing it??

of several clubs and former president and committee of a couple i would say i have never seen fish sold.In any form.Have seen fish given away to the public often but not sold.I dont see a problem if fish caught is cooked up on site in exchange for a small donation to the club as a form of fundraising but cant say i have seen that either.I dont think i will be donating my red emperor when i finally get a good one.;)

yeah I think you'll find "sale" includes things like swap, trade, barter etc and Fisheries wouldn't look too fondly on this, even if it was done with the best intentions. I personally wouldn't risk it, too much to lose if it went wrong.
Better off giving it away and charging double for a plate of salad.

Tim is spot on the money, it is illegal to sell the fish that has been donated from an AMATEUR but if a pro donates it along with a receipt its legal.

Have heard of it happening and fisheries officers turning a blind eye when its for fund raising but with the penalties involved you would have to be very careful.

If you are actually selling (entering into an offer and acceptance situation) then I think you may have a problem. On the other hand if you are requesting or suggesting that a donation is appropriate (and not mandatory) that's perhaps another matter.

Unrelated but there is an Indian restaurant in the CBD of Perth, on I am sure a very expensive piece of real estate, where you can eat for free. A donation is requested.

I would say a big "No". What's to stop an ammatuer catching crays or fish to supply their local club. This happened recently in Cervantes and the guy running the club was prosecuted...I think he may have been the one catching the crays as well!!

And what about other clubs such as sailing clubs. Most sailing clubs run a fishing section. Is is ok for this section to run clinics and use these fish to supply the kitchen?

Even with the best of intentions I think the Fisheries would come down on you. I can't think of too many 'loopholes' in fisheries law.

Can you guarantee the fish has been prepared properly, ie.  been bled and stored on ice.

I dont trust anyones fish, when I have not seen the storage conditions from the time of capture
