Terrible tragedy, but looks like lack of sense and a few other issues may come up.

I was reading a few more articles and popped in to a couple of ES forums - as to be expected, there is a lot of accusation, speculation and uncertainty. It appears clear that the boat was stolen, hopelessly overlaidened and it's reported that there was allegedly alcohol involved as far as the ex navy boat was concerned. Very traumatic for the all involved and tragic for those related.
