THE federal government has reached a legal settlement with the captain of a Vietnamese fishing boat after it destroyed the vessel he used to bring 53 asylum seekers to Australia in 2003.

The confidential settlement ends a long-running court case which has cost the government millions.

Last year three Federal Court judges ruled that if the government could not establish a lawful basis for destroying the boat, the Hao Kiet, its captain was entitled to compensation.

In 2003 the government reopened the Christmas Island detention centre to house the asylum seekers and spent $50 million keeping them there for two years before all were granted temporary protection visas.

this makes my blood boil! How can we show a strong face against people smugglers when judges rule like this!!!

time to make judges do a few hours of community service every week, as they out of touch with reality and the people!

We are one of the weakest countries in the modern world!!!

There is never any hesitation from either side of Government to F%ck over real Australians at the drop of a hat, but when it comes to ILLEGAL immigrants (and other minority groups with or without Australian residence status) they bend over and cant help enough in fear of discrinination or a poor Human Rights score card from some overeducated, undersexed, overweight lesbian maggot from the United Nations who barely speaks engrish.

These people are coming here because they are too cowardly to fight and defend their own country and beliefs - and before everyone calls me a narrow minded biggott - if they are that down trodden and desperate, how can they afford to pay somaone tens of thousands of dollars EACH to get smuggled into our country, destroying their identification before they get caught so their identity is unknown?

Atleast our troops are fighting their war and dying for them........

I can't even get my twin sisters, baby niece  and brother inlaw in here legaly!

one is qualfied as a pre-school teacher and the other repairs histrocial books with her husband who is trades saleman.

All three would have a job, contribute to the society and become true blue Aussies if given a chance, yet you can hop on boat in Indo, take your chances with the sea and be given  a "free pass in" once you get to Christmass Island!

I don't begrudge the refugee, I begrudge the system that makes it hard for honest people to get in and rewards those that take the illegal routes!

the wheel that squeaks the most gets the grease. I know under the Un charter have  to give safe anchorage to these dole bludgers, but from what I've read the first port of call is were they are legally entitled to seek aslyum which is Indonesia not Xmas Island, go figure.  I just can't understand them leaving their country when they all should be figting for their freedom, along side our diggers and other army forces that are there.

Tony I feel your pain for your twin sisters, have friends also trying to get blood relations over here.  Maybe they all should go to Indonesia, hop on a leaky boat and seek aslyum here.

I also don't begrudge immigrants coming here, as long as they come through the front door, don't care what colour skin or religion they are, just do it legally.

Don't know if their any any lawyers on FW, but my question is how can non Australians get lawyers, legal aid, when they aren't Aussie citizens?

Qld 's Anna  Wasted money hand over fist in that state with toll road and tunnels everywhere that no one uses..  Power stations green eco friendly scraped and it goes on..  Qld coffersd are empty and now they have to rebuild all the infrastructure..  Same in NSW and Canberra.  They (labor ) never save for a rainy day... If the three Federal Court judges ruled that if the government could not establish a lawful basis for destroying the boat then it would suggest to me that it wasn't the judges that got it wrong.  The judges are there to ensure the law is upheld and in this case in their opinion it was.  Perhaps the law didn't suit the occasion but that is not the judges' fault.?

The world would be a very different place today in that instance.  If there is no law to suit the occasion it must be lawful.  There were no different rulings in this case.  Like it ot not I'm confident the judges made the right decision in accordance with the law.

Ahh thats a crazy claim, even for your usual paranoid anti-ALP rantings. The first problem is Asylum Seekers can't vote. Before we start on political bias, there are only about 13k a year, and that number has remained pretty much flat since 2004. Oh and Australia has at least 11million voters, so 13k is a pretty pissant number.
