Daily Occurance in Dampier with Billies......

Got this off a mate today, and it happens every other day. Ill take a Genset and a Drill next time or just call them nasty names, seems to get a better reaction. Luckily, the fisheries still pull us locals up and count every Gardy and/or Mullet in our possesion whenever they come across us after a bait session. Thank god for that!
Also luckily, just for the record, No GT's were harmed in the making of this photo.
Gives me the shits.

Is there a law against catching marlin from a container ship. Im only 11 years old, Im not trying to be smart but if there going to eat it whats the problem.Its not like theres a shortage of billys or even a law against catching them to eat. Or is there????Ive heard there not to bad to eat.Has anybody eaten one?????

Jaxen, fair point mate but put it this way, every ship out there has up to 4-5 lines sometimes more off the back of the bow. WA fishing laws state you must hold a recreational fishing from a boat licence to keep your catch, my money is on the fact they won't have one, this is one fish, sure they probably eat it and yeah thats fine with me i guess but if that was me caught with a billfish, with no licence i';d have my boat taken off me, all my gear and a big fine. Not going to happen to the crew on the ore ships now is it? I'm sure fisheries know about it too, pretty powerless to stop it really. There can be up to 17-20 ships waiting out there at any time just off Dampier, say 6 off Cape Lambert, god knows hpw many off Port Hedland doing the same also, i won't even get into the ships filling up oil off the mooring bouys and FPSO's down the coast, it all adds up mate.
You heard right they don't taste too bad, marlin are better than sailfish but smaller the better, we don't get the big 200lbs plus up here, a 40kg marlin is a good fish off Dampier so probably taste alright, sailfish i wouldn't bother.

Not saying what they are doing is right but when you are on a $5 a day food budget a few free fish go a long way. Its not just up north it happens its every port in Australia and probably the world, these guys on the ships dont know any better and until told they will continue doing it. It wouldnt be hard for fisheries to contact local customs who board the ships and get them to pass the message on, oh but hang on that would mean 2 govt departments actually doing something together might be better of tying a note to the spud and send it to em that way.

Its not only the billies
They are also cleaning up in our ports and when on anchor. Time and time again we have to stop them from pulling in GT after GT. And at night they clean up on the Mulloway. One of our shifts counted 40+ one night! And word is that a lot of it is not for them to eat. Apparently they fill up their freezers and take it back home and sell it. Extra cash for the crew. Im all for if your going to eat it then keep what you can eat but they dont know when to stop.

Most of these guys are at sea for 9 months at a time and get flown home from whateva port they are in when there time is up so i dont know how they could take much home. That said its still wrong, down our way i have emptied buckets of undersize fish and crabs over the side when i see them and tell them its illegal. once told they are shit scared of the authorities and dont want to jeperdise there jobs and stop fishing. Like i said before if the Authorities work together it will be stopped but until then the show will go on.

1. The sovereignty of a coastal State extends, beyond its land territory and internal waters and, in the case of an archipelagic State, its archipelagic waters, to an adjacent belt of sea, described as the territorial sea.
2. This sovereignty extends to the air space over the territorial sea as well as to its bed and subsoil.

SECTION 2. LIMITS OF THE TERRITORIAL SEA
Article 3
Breadth of the territorial sea
Every State has the right to establish the breadth of its territorial sea up to a limit not exceeding 12 nautical miles, measured from baselines determined in accordance with this Convention.

Article 17
Right of innocent passage
Subject to this Convention, ships of all States, whether coastal or land‑locked, enjoy the right of innocent passage through the territorial sea.
Article 18
Meaning of passage
1. Passage means navigation through the territorial sea for the purpose of:
(a) traversing that sea without entering internal waters or calling at a roadstead or port facility outside internal waters; or
(b) proceeding to or from internal waters or a call at such roadstead or port facility.
2. Passage shall be continuous and expeditious. However, passage includes stopping and anchoring, but only in so far as the same are incidental to ordinary navigation or are rendered necessary by force majeure or distress or for the purpose of rendering assistance to persons, ships or aircraft in danger or distress.
Article 19
Meaning of innocent passage
1. Passage is innocent so long as it is not prejudicial to the peace, good order or security of the coastal State. Such passage shall take place in conformity with this Convention and with other rules of international law.
2. Passage of a foreign ship shall be considered to be prejudicial to the peace, good order or security of the coastal State if in the territorial sea it engages in any of the following activities:
(a) any threat or use of force against the sovereignty, territorial integrity or political independence of the coastal State, or in any other manner in violation of the principles of international law embodied in the Charter of the United Nations;
(b) any exercise or practice with weapons of any kind;
(c) any act aimed at collecting information to the prejudice of the defence or security of the coastal State;
(d) any act or propaganda aimed at affecting the defence or security of the coastal State;
(e) the launching, landing or taking on board of any aircraft;
(f) the launching, landing or taking on board of any military device;
(g) the loading or unloading of any commodity, currency or person contrary to the customs, fiscal, immigration or sanitary laws and regulations of the coastal State;

(i) any fishing activities;
(j) the carrying out of research or survey activities;
(k) any act aimed at interfering with any systems of communication or any other facilities or installations of the coastal State;

i am australian and am working in the offshore industry we fish while were are at work to eat and to take some home for our families when its time to go home
within the normal laws of rec fishing and bag limits

i dont see any hassle with people fishing, but they MUST (eg bag limits, rfbl, etc) obey the rules, do any of the members here talk to the media, this could be a topical issue for them with all the fishing zone talk in the media at present

Isn't it against the law to recreationaly fish from a commercial vessel anyway? I know on the cray and ocky boats its a big nono to drop a line.
