Just wondering, what is the deal with sharked demersal? If the boat had caught 2 dhuies and and so happens if a third was hooked and sharked must we throw the remaining bit of fish back? Seems like a waste if we had to.
Yes, it is a waste but the way the legislation is worded and has to be complied with means that they must go back to the thieving bugger who got the tail section.
Bloody shame.
If a fish can not be succesfully released and you could use it for consumption or other purposes I would keep the carcass and go to court and argue my case on logics.Myself and everyone I know work with the system regards bag and size limits.I doubt someone who has an expensive boat and gear would willfully mutilate a fish just to keep a bit more,It has always been more time and cost effective to go fishing at Ciccerellos or Kallis. That dhu has clearly been sharked by a decent size animal.I have lived in west aust since 1967 and enjoyed the north west and other places when there was no rules or regulation and was with the freezer fillers and remember the factory in welshpool that advertized the one ton freezer trailer for the north. It held 800-1000kg of fillets. We are managing our fishery with closures and size limits for the future sustainabilty based on research.throwing back half a fish to get a better fish does not make sense.
I anticipate most reasonable people, (particulary non-fishing "peer/jury" type people) would conclude if you've taken 2 whole fish, and have then taken a third "sharked" fish instead of return it to the water to be eaten by its natural predators (and not wasted), you have in fact removed 3 fish that day, one above your bag limit and in breach of the legislation which you agree to abide by when getting your license to fish from a boat.
I'm not taking sides here, just telling it like it seems.

Wondering x 2
were the remnants bigger than 50cm?
it looks like a maybe 55-65cm fish, and fisheries would need to have had a bad day, but technically could they ping you for bringing that back in??
cheers

Logic has no place in law.
