Carter case
Hi All,
I know the Brett Carter case was big news and debate on here at the time but is has drifted into the distance.
Unfortunately not for Brett and the case is still ongoing and the Fisheries have relentlessly pursued this prosecution through multiple levels of the legal system.
I brought this to the attention of a good friend of mine Rachel who is an avid diver and a barrister back in Dec 2016. She decided to help Brett free of charge and has spent MANY (I was shocked at the total) hours on this protracted case.
The stress of 4 years of prosecution on Brett has been traumatic as you could imagine. The decision now is to take a plea on a slightly reduced charge and hopefully the fine will be reduced to the minimum reflecting the nature of the offence and the hardship and financial loss already suffered Brett (lawyers fees before Rachel).
Anyway, there are a couple of things that could help with the plea mitigation. It would be good if people could help out to reduce the workload on Rachel and stress on Brett.
Items outstanding:
- Press releases or information posted by fisheries which will show their approach to policy. Any notices on public forums or to the recfish community generally would be awesome. I’ve had some useful stuff from recfish so far, including a letter of support in our plea that fisheries discontinue the prosecution – but it didn’t work.
- Character references from anybody who knows Brett, as many as possible.
If any of you have a bit of spare time to do a bit of web research or can write a character reference, PM me and I will act as the conduit to Rachel.
I know there were and are lots of oppinions out there regarding this case, but this is not a thread to start all that up again. It's time to put it to bed so if you can help please let me know.

Bret Carter
When the recent changes to the cray season were announced I took the opportunity to write to the minister applauding the move.
And then brought up Brets case again.
I received a personal message a few days back along the lines that it was an ongoing case before the courts and he could not discuss it.
Im in the process of drafting a reply to him.
However I suggest that people who have an interest in both the case and Brets situation send an email to the Fisheries minister Dave Kelly.

Perhaps reinforcing the damage done to Fisheries standing, the effect on the person involved, and the confusion that still exists in the fishing community due to the manner in which Fisheries has conducted themselves.
This should be done as soon as possible or it will be too late.

I can't beleive
It has gone on for so long. I did hear the pressure off the whole situation and hounding from fisheries has taken its toll on his health. I work with one of his good mates. No rules where broken, but they the fisheries , hate to loose or admit they have gone to far on this one . Very sad situation indeed.

I'm not sure a letter to the minister will help with the plea mitigation. Of course it would be a nice thing to do. The fisheries have won now. It will be up to the magistrate what the sentence is and he will base his judgement on what he is presentended with. Anyway, I'm no expert, I'm just passing on the information and request for assistance.

That may be true, but there is also the bigger picture of avoiding this happening again.
Providing contacts helps get those few who make it as far as typing an email get motivated so here they are

I thought the proposed changes were Minister Kelly's way of indicating that Bret would be looked after, as the proposed changes are exactly what Fisheries were trying to pin on him. apparently not.

Fisheries never loose
They can even get away from abuseing people outside court room, when they lost first court case. If that was a police officer he would have been stood down ( load of s$"t in my books).good public relations .good to see support still there for mr carter. I was same as scotto, thought would be over,after seeing apparently new rules. Gone on to long and pushed many boydarys in my books, load of crap. But let's waste thousands of tax payers dollars on the word take.once cray snared you have taken it. Why can you snare a marron ,size, then return to water?. Same as scooping crabs. Load of crap , very poor form.
