Crayfish catch

If there are three people with licences on board and there are subsequently 6 craypots in the water and on pulling the first craypot there are 24 crayfish in the one pot, are you legally permitted to take the 24 crayfish out of that craypot or just 8, that craypot is subject to one licence which is indicated on the float. If the other two people on board, in theory take 8 of those crayfish each are they not taking crayfish from another persons craypot, i.e. interfering with someone elses craypot?

I know all anyone should say if queried by Fisheries is that the 24 crayfish were caught out of the 6 craypots, but interesting scenario, what are your thoughts?

I am aware that this has happened, especially this season, unfortunately not here in Kalbarri!!!!!!!!!!!!!!!!!!!!!!!!!!!!

Why on earth would you tell anyone there was 24 in the first pot anyhow?

I do not believe that it is illegal anyhow (has anyone been actually prosecuted for this??) and just because an individual officer may say you cant, doesnt make it illegal.

Any government officer will say "no" if you ask them a curly question as a matter of course-

"I cant recall how many were in the first pot sir".

This sort of thing is something Im getting jacked with Fisheries about-making up stupid rules on the fly with little or no consultation and minimal practical thought-as above making Old Banga into either a liar, criminal or hungry when he probably is actually a totally law abiding useful member of society.

WHAT POSSIBLE HARM TO ANYONE OR ANYTHING WOULD RESULT FROM OLD BANGAS SCENARIO ABOVE EXCEPT A GREAT ANNOYANCE????

As another member here is aware, I am making enquiries on a few issues, as regards why Recfishwest are either not representing our views or (more likely) Fisheries are not consulting our peak body and just doing whatever the f++k they like.

But Jorn lost his dads crays and got a written warning. Technically the crays have to come out of YOUR pot. Just like a diver will get done if they come back to the boat with more than 8 crays even if they are sharing a catch bag!

 

Its ben heavily debated on another forumn a few years ago!

 

I agree there is no harm and no annoyance and why not go after people taking 500 crays and selling them....

 Totally agree , wholeheartly rob h, bring in common sense , etc etc, couldnt agree more.

 

 ok , now onto what we all have become part off , whether we like it or not.

 Having had long conversations , with a shire ranger , and 2 different fisheries personnell in the last 12 months , common sense, realality

 has no bearing in todays rule enforcers take on it.

 Im old school , like many on here , I expect people to use common sense , and on being shown the sense in things , maybe , just maybe 

 concede the point, or even question the wisedom of the rules themselves. Rules are usually flawed in someway, as there thrashed out by mere

 humans , which by nature are flawed.

 Dont happen, the guys , and girls I have spoken too , will argue black is white , if its in the book, even if you prove in front of them

 white is white , they will thank you politely , and then fine you for it.

 thats my experience , to the point where , when approached by a ranger resently( not doing anything wrong , i will add) , I just  got in the car , no

 words , and drove away.

Even a written warning doesnt necessarily prove it is illegal, some of the professional guys I know have over recent years, taking to refusing to accept a written warning and instead insisting on a prosecution if any catches are to be seized (such as borderline setose etc)

In some cases this has gone no where.

 try ouin 12 to 14s off back of the bluff on the dog leg glenn. Big spawning area and when they clean up shortly youll crack the 24!! 

Or take one out to 19s off the holes nth haybails!!
