expensive day out for my mate

trip to South West Bank , predicted glass off conditions , on the way out quite large swells , made things tough in my little boat , coming home was better , but it was worse for my mate he caught 2 black arse one went 34cm and the second one went just a touch over 30 cm they were the only decent fish caught for the day on the way back to point perron my mates rod bounces out of the rod holder and hits the deck result bail arm holder on his stradic fj 8000 snaps clean of . when we get back to pp fisheries are waiting , polite young woman asks if she can have a look at or catch told her no worries she plucks the smaller black arse out of the ice slurry are you sure this is 30 cms my mate says yes was just over when measured when first caught . Fisheries girl says I need to measure it with our ruler , turns out it is 3mm under , my mate tried to explain the fact of cold water and shrinkage ( as every man knows cold water equals shrinkage of parts of anatomy )she couldn't understand what he meant and ended up with a S200 fine, I thought it was going to me at first with the fine but my mate said although it was my boat , he had skippered it for the day, I have told him I will go halves in the fine, he asked how about the reel repairs it was your boat , he is my best mate but I told him don't push it haha

 No good for you or your mate but gotta say a 30cm black arse is hardly worth keeping, I know it is the limit but as far as I am concerned the amount of meat you get of a 30 cm specimen is pitifull. I generally put them back if they are under 40cm.

but when you have been spoilt over the years like me and my mate have fish wise living in the north west , and then moving to the metro and having to learn a completely different way of fishing and trying to find some productive ground between us we now have in 18 months 2 size dhuies 2 size black arse, countless undersize pinkiys a couple of hundred sand whiting , and 1 huge KGW (well we thought it was huge)and to many pesky sambos , oh yea and just to make us feel at home a few Nor West blowies

 Yeah , a bit harsh. I have no idea why blackbums are even part of the demersal bag limit. I constantly see them floating on the surface because a fisho wanted to upgrade to a better fish.(IMO ) 

But we all should check the stickers and brag mats used to measure fish. After seeing it on FW a while ago( how they can be wrong ) I run a tape measure over them and correct the issue. I also bought a crab gauge not long ago that was 1mm under the legal size, i know fisheries won't care and would have charged me if i had undersize crab's.

Even the fisheries sticker/ruler, say's " this is only a guide "

 Hard luck Pete. I opted to release a 55.5 cm barra the other day worried about shrinkage. I know a 55 cm fish is small but on the day we boated 3 undersize barra and the only fish that would have been nice in the esky were lost boatside. Thats fishing, otherwise it would be called catching.

thats tough didnt see fisheries at freo ramp at all yesterday deckie caught a dhuie that was just sized and mentioned to him about shrinkage hence it went back with the release weight was pretty quiet on the water yesterday except for the tuna we saw jumping

as you'll see by the reports of the tagged fish on here most aren't fast growing , most legal sizes are so the fish would of had atleast 1 breeding season before being dinner that 3mm could be the difference

I measure my fish to the fork , not the tips of the tail, that way you are covered. For fish with paddle tails always give at least 25mm

 Be careful using a tape measure as Vinesh said. The extra length gained by the tape wrapping around the body can be considerable. Proper measurements are taken by a flat measuring device and will be shorter. If you're one who keeps fish right on their limit it will catch you out eventually.

my mate didn't try to hide any thing and he believed it measured size , what pissed me of was she said we will measure it with our measure which turns out to be a steel rule that was siting in the sun , as an instro elecy I know the fact that is that steel 1 meter rule left in the sun on a 38 degree day could grow buy more that 3mm and the more accurate measure was the sticker on the boat

 Errr I don't think so mate. Most rulers are stainless and and you'd be battling to get it to grow half a mm, I've been in the steel game for 30 years and know all about how steel grows and shrinks. Maybe just maybe if you put an oxy to it and hammered it to make it stretch. You're clutching at straws Peter, just accept the fact that you mate was pinged fair and square and make more of an effort next time to ensure your fish are size.

Similar sort of thing happened to a mate of mine. Fisheries came onbaord our boat, inspected our crays. My mate had one that suspect setose. One fisheries guy said 'I think this is setose?' asked his mate to confirm, he wasn't sure. So they took his details, he ended up with a fine???????/

 

If fisheries can't be sure, what chance do we have?
Surely if they couldn't decide, he should have got a caution.

I was happy to go to court should he wish to fight it, but he declined

I think fisheries do on the whole a good job and they do a necessary job other wise we would end up like a banana republic without any bandannas. However no matter what you get from fisheries it always comes with an escape clause, i.e.; fishing ruler "this is only a guide" don't try to use it is a defence in court. Then any correspondence that comes from them always has an escape paragraph at the bottom of the page that basically says, if this advice is wrong you can't hold us responsible for the advice we have given you.
A couple of questions go begging, is this because no one will fess up to making a decision about anything in case they have got it wrong, or we can not be sure that the advice and or tool (fishing size ruler) will be used in the correct way.
What carnarvonite says about measuring fish is true, it's best to make sure your catch is 5 - 10mm over size (as per fisheries rule) than right on size.
Just my view on the keeping fish of the right size

totally agree with your comments , my mate is happy to pay the fine if it was me I would challenge that a steel rule left in the sun could grow over 3mm and then isn't accurate, I was nearly going to ask her for the cal sticker , For the uninformed any revinue raising devise needs to be calibrated minumin of ever 3 months , they are thing like parking meters they should also have a cal sticker on them in car speed radars are supposed to be tested every day by the cops the simple fact is as far as I have seen less than 10 % can do the test properly , the test is done with a tuneing fork
