Anyone here deal with Insurance - Indemnity?

Hi Crew,

With the FW site hosting several fishing competitions over the next year I guess its imperitive to find out a little about indemnity insurance and whether a simple signing of a contract will save me and other organisers hassle into the future as we simply can't afford to insure each event.  Is any member involved in the industry or have a contact that I can speak to?  (someone that won't cost me my arms and legs either)

Cheers,

Adam

looks like we need to purchase a public liability insurance premium......

other clubs have an entrant fee to cover the yearly cost.

need to look at cost Vs number of comps to reduce entrant fees to cover the premium

will make some more enquiries.

So you can't just get people to sign that they do everything at their own risk and its not our problem?  Gawd that sucks.

Bluewater Classic Central Coast Gamefishing Club  27,28,29 December 2009

http://www.ccgfc.com.au/wordpress/wp-content/uploads/2009/10/Blue-Water-Classic-09-Tournament-Entry-Form.pdf

This competition gets contestants to sign a complete waiver (2nd page) absolving them from everything plus the competing boats must sign a declaration that they have $10 million public liability.

Every boat owner should have public liability anyway to cover any unforeseen circumstances that arise either at sea or on land.

And

NATIONAL BREAM CLASSIC TOURNAMENT 2007 RULES

7. Insurance & Liability

  • It is the sole responsibility of the boat owner to carry adequate public liability insurance covering them and their passengers. All contestants are required to sign a waiver absolving the tournament sponsors, so-sponsors, and their employees from any responsibility for any damage or personal injury sustained as a result of their participation in the tournament or related activities.

Waivers aren't worth the paper they're printed on, I bet that hasnt ever been tested.

Waivers

Waivers of Subrogation and Release and Waiver documents are commonly used within the oil and gas and mining industry within Australia so I would not go as far as to say waivers are not worth the paper they are written on.  I agree however that the examples posted by "bod" have probably not been tested.

if you were to get some forms set up and people signed them it then would come down to the individuals own integrity if something happened.i for one wouldnt even consider trying to get anything out of fishwrecked , my boat is insured and that covers any one and anything that is damaged lost or stolen.i would say everyone elses boats would be covered the same way.in reality everyone goes out on the water at their own risk so why would this be any different.

I will go with the waiver I think, the site can't afford insurance and it will blow the competition entry fees out of the water (I would assume)  The entry night for the Exxy comp will be in the Lighthouse Caravan park car park again and I'm still weighing up where to hold the finale, depends on numbers I suppose.

Goatch - You've got it in one

Sad but true.  No one seems to be responsible for their own actions and / or stupidity anymore.  The litigious nature or the American culture is rubbing off.  Beware around the corner there may well be someone who wants to take advantage of a situation and get something for nothing at your expense.
