Dog laws
Submitted by pale ale on Thu, 2013-08-22 09:37
Yesterday morning, we had an uninvited guest trying enter our house. Luckily for the young aboriginal girl, we managed to stop my dog from tearing her apart.
This now has me thinking, what is the best way to protect myself from the law, and to protect my dog from the gas chamber.
What legally can I do? ie Enter at own risk signs?
Anyone had this problem before. I would hate to see my best mate get put down

As far as I know if he's
As far as I know if he's fenced off and you have a sign on the gate then tough shit for anyone jumping your fence.

Guy at work here who knows
Guy at work here who knows alot about legal stuff just said that as soon as you put up a warning sign then you are admitting that your dog is dangerous .
I hope this isnt the case as i hope to get a german sheperd soon and dont care an inch if it mauls a theif on my property but never want to see it put down either

Yeah
Yeah thats the way i understand it , after a few heated words with the local ranger.
I have my dog at work all the time ( Factory ) I took down all the signs and replaced them with ( Beware Dog On premises ) This way i'm not stating it is a dangerous dog, just that there is one there.
At the end of the day , i think anyone bitten by a dog , even on your property and they are trespassing, can try to have you charged and the dog put down. Then it comes down to who can afford the best lawyer.

Dog laws
If they get bitten whilst committing a criminal offence (trespass or B+E) then there is no liability for your animal. For this they need to be in your fenced back yard or in house in the process of commiting an offence, not running down the street with your dog chasing. Remember to have the dog registered with the council though.
Your front yard becomes an issue because you have to leave access to the front door and anyone has the right to knock on your door without fear of being bitten. This can also mean people lurking in your garden, if they enter the premises then its game on.
If someone you have invited in or has permission or reason (rangers, police etc or dare i say fisheries) to be in the house and they get bitten you will be liable no matter what.
In terms of signage, beware or dangerous dog that will make it easier for someone to sue for damages if they are bitten or hurt by the dog. I have a Rottie and simply have a sign on the door and gate that says, Rottweiller live here. Haven't been burgled once and I'm not admitting its dangerous even though its not anyway

My dog would probably lick
My dog would probably lick people to death too.... if they were invited in. But to have a drugged up smelly feral walk up to and open the door where my daughters were inside, he went nuts. Fortunately my missus held him back, cos I'm sure there would have been blood!
I'm going to get some signs made up, but want the best wording to ensure I am covered if these scum try it again.

I remember back when i lived
I remember back when i lived in lockridge we always had people jumping our fence and looking through our shed so i chucked some old rubbish like wood sheets with nails on it right where they land when they jump down. It took a week but i got him. Must of stuck in his foot . Almost a perfect bare foot print of blood on a sheet of wood and it was 10 meters from where i put it. Never had anyone jump the fence again but i was informed later that its not allowed.
I now can see why, if police are chasing anyone over fences and they get hurt then look out. Never done it again but i do feel strongly that you should be allowed to protect you house and family no matter what. Sometimes you just cant rely on the law

Don't see how puting up a dangerous or vicious dog sign up can show you know your dog is dangerous (even if someone tries to claim this).
I put the sign up as deterence to someone entering the property/climbing the fence not to warn anyone of my dog would be my answer. Bunnings and everyone else who sells these signs (including alarmed premises signs etc) sells the signs as a method of deterence.
Who's to say you even have a dog just because a sign is present - and lastly your honour the sign was there when I moved in.
I have two maltese/shitzu/poodles and a dangerous dog on premises sign - does this suggest I know the little rats are dangerous.
They are great alarms however as one little prick found out......

Put “Guard dog on premises”
Put “Guard dog on premises” Guard dog doesn’t have to be necessarily dangerous and if you run a business from home, dog’s expenses can be tax deductible.

I generally dont have to
I generally dont have to worry about intruders as the four dogs let me or the wife know if someone puts a foot on the driveway if the intruder gets pass them he wont get out as one is trained to hold where as the other 3 would go crazy just bury the remains problem solved at least your roses will look lovely lol

Beware of Dog ... on my gate
Beware of Dog ... on my gate , my argument would be that its there so people don't leave the gate open . My old mastiff cross has given a few love bites but doesn't try to rip them apart .
Also for some of you that leave boats in open access driveways etc . You can place in them Swann wireless IR sensor alarms that work well , that transmit back to receiver which is in the house .

I spoke to the Roebourne
I spoke to the Roebourne Shire Ranger (dog catcher). Good bloke he was, and he said if the yard is secure enough that your dog can't escape, you will be ok. Any intruder who is bitten, it is their fault. You need to have safe access to your front door, and also to the power / water meters.
So, next time the local indigenous scum jump the fence, the dog is allowed to have a taste!
The "Declared dangerous dogs" need to have a special sign. If you dog is not declared dangerous, you cannot show the official sign.

Maybe run with a "Large Dog
Maybe run with a "Large Dog On Premises" sign will do, doesn't say it's dangerous just stating a fact. Nice to see some common sense and the law siding with the victim for once

ridiculous
what are we coming to, if some prick jumps my fence i want both my dogs to do the job i own them for, guard my possesions and alert me if anyone is around, if it did happen and authorities wanted to euthanase, my dogs would vanish pretty quick! should not need to advertise you own a dangerous breed to anyone what a crock!

Honestly she was about 18yo and would have only weighed 40kg. Must have been on some wicked drugs as she didn't even see us standing 3 metres away.

dodgy laws
dodgy laws unfortunately n they protect the intruders!
its funny because if you have a property w sheep on it and have a maremma sheep dog protecting the sheep and someone jumps over the dog will be protected after ripping your neck off because it is a working dog doing its job!
i can tell ya i have a 5yr old maremma and if someone jumps my fence hes goba use their legs as a chew toy! a gentle giant with a genetic imprint to protect his flock!
and the fact that he recognizes and hates the scent of certain people is even better!
some dogs are genetically imprinted with an attack mode and others are protecting dogs. NO ONE WILL PUT MY DOG DOWN IF HE PROTECTS MY FAMILY AND MY FISHING GEAR!!

Maremma Dog
hey Tangles , I was considering one .. do they stick with the flock 24 / 7 or are they still social with family .. My ole mastiff X is really old now but is bullet proof with livestock , sheep , chooks and little kids etc and has never tried to leave property even if the gate was open .. going to be a buggar replacing him , got lucky with him best dog I've had .. I presume with the Maremmas instinct they think for themselves however are they trainable and responsive . If another dog was being walked along the front of property are they the sort to give a few barks or do they go ballistic in kill mode to get to the other dog .. cheers in advance
