Marvelous outcome, and quite probably justice served.

However, I read the story, and barring the quite possibly poor reporting standards it concerns me.

Im all for this crime getting punished but the story (to me) read that there were no witnesses, no video/pics and Fisheries were not present.

Certainly he may have been stealing "a cray" and Im not casting any aspertions on this particular case.

But is it really that easy to catch someone doing that and have them fined $12K and lose their boat?

Best be careful next time someone yells at you on the water and you "give them the finger" or "throw a sinker at them", or you cut them off at the ramp.

If they only need to tell Fisheries a plausible story, there could easily be a couple of innocent people amongst the multitude caught doing this over the last couple of seasons.

Fisheries have demonstrated already that they are unwilling to back down no matter what...

I’m going to assume that since this was a penalty handed out in court for what is presumably a criminal charge, that the magistrate was doing his job and took into account all the evidence and testimony to make his decision.   Far cry from being handed a penalty because someone reported you.

If you try some bullshit story and admit during your testimony (and likely to Fisheries initially) that you pulled someone else's cray pot out of the water you're kinda leaving yourself open to whatever punishment comes your way.

Also agree this chap did the wrong thing, however he also did state that he was untangling rope,

And to do that may have had to lift the pot out of the water, whichever way you look at it

very harsh penalty when you think a guy can shoot someone in the neck, has a multitude of other related charges and gets bail

Sadly the punishment doesnt always fit the crime

Being an Oldie myself and just had my boat delivered although still waiting for the 275 Tranny to arrive, I wonder what I am in for being this age,

No doubt as it is a Black Cusher I will be labelled a pinger, be too slow at the ramp causing rage, have to rely on sea rescue etc etc etc, should be fun,

Oh and I can fish when all you youngins are at work, what a bugger,

As for claiming Dementia as a defence, Ron, I think you have to remember you suffer from it,

 your not wrong on all fronts there. as a truck driver you see all sorts of stuff on the roads , you just have to look around when at a red light and see how many other drivers are sending text messages. 

as far as the water goes only yesterday we had another boat cut straight accross in front of us maybe 20mtrs only to cut back accross to avoid a cray pot.

Hezzy I agree with everything you say, also not bothered by the penanlty handed out to this "old guy" and as LJ said, you touch someone elses gear you pay the price.

Gladly though, some of us Oldies still have a bit of common sense for what that is worth these days, and learnt respect along the way,

I do however get annoyed when soft Magistrates allow people who commit crimes that endanger the life of those around them to walk free.

When are we going to stop accepting the offender had a tough upbringing, he came from a split home, he was under the influence of an illicit substance etc etc etc.
