Was the pot itself marked with your rego
If so I would first have a diver confirm it is indeed your pot as then you can legitimately pull it otherwise as the law stands you are pulling someone else's pot and would face prosecution.
We see plenty of old ones out there particularly around FFB and beyond even with floats barely on the surface as the ropes are encrusted with all sorts of marine growth but would never consider pulling given the legal issues involved.

Pull it and check if its yours, with a mate..
If its not, put it back - no harm, no foul..
Mate will verify the story if it is an issue?

yep, pull it
do a bit of recon first if you worried.
If they catch you and its not yours just tell them you were checking on them to see if they were doing their job!

Be careful
About pulling gear that does not have your ID on the float. I have seen Fisheries set up a sting on a pro who was a bit loose with honesty, put a pot out with only a single float and no ID on a popular stretch. Observed this bloke pulling it from a distance, so they set marked crays in the pot, then checked his catch and found them in it. Cost him a lot of money and a black mark on his licence. if it has been there since last season, it will be worthless anyway--worms will have riddled the timber, and even the steel bottom wouldn't be much good if the anode has dissolved. As pro's, we wouldn't bother with pulling really old pots we found--just covers the deck with crap, and you get nothing anyway. Find a pot chopped off with no floats? We would pull them and bring them in, put them on the jetty if they weren't ours, notify the owner. Still a bit of a grey area, but informing the owner directly covers you for intent.(probably)
