Bag limit question

Wondering whether anyone can answer this.

 

Last time I went out night fishing we got our 2 dhu limit pretty quickly and then started targeting other species.

 

However later in the night we got another dhuie as bycatch. The fish was stuffed and I very much doubt it survived, but I tried to release it anyway as we already had out limit.

 

It wasnt until the next day that I wondered whether I was able to keep it, as by the time we had returned to shore it was 3am.

 

Given that we started fishing around 8pm the day previously, could we have kept it given that we were out there over 2 days and 3 fish is less than 2 days limit?

dosnt say for 1 or 2 day trip just that theres a boat limit so a bit of a grey area that one

I am not 100% sure but as I recall individual or boat limits apply over a 24 hour day, midnight to midnight.  It was recommended that you have proof (dated pics) of the times captures were made as the onus was on you to demonstrate you had captured the fish in question over a two day period.

I think you would would need to doa  bit more than fish before midnight, perhaps their day is a 24hr period, ie; more than one bag limit requires a trip of more than 24hrs in any case.

Its confusing whether the "boat limit" applies for multiple day trips. I am of the opinion that the entire 'bag limits' only applies per day and as such the dhuie limit is per day (it is listed under the daily bag limits). I rang fisheries gero and they confirmed it, but I got the feeling that individual officers would see things differently. Might have to get it in writing next time :p Though they probably wont oblige which really means no-one has a clue...

 

With regards to bag limits, it is a 24hr period, midnight to midnight. However, I think in order to get two bag limits you must make a "lawful overnight stay" on an island (I think it includes sanctioned moorings too though?). Says min 5hrs and past midnight.  However, in the fisheries book it makes it more confusing as it then mentions "been at sea or stayed on any island for more than a day". Confusing.

 

I think unless you're fishing over 24hrs, or staying overnight on an island, you'd still only be allowed one days bag limit at the ramp though? Makes you wonder where you can actually get real clarification on these confusing issues. Bit pointless if one fisheries person says one thing then you get busted by another who has a different interpretation. Would be nice if there was an authority on it. "Sorry, but I have a letter from Mr. X who says I can do this"

because people could just have a really early start and bring in 4 dhufish and so it was 2 days?

if you are out spanning midnight you have 2 days bag limit and so long as the possession limit isnt exceeded.
