Parking boat on the verge and Council by-laws

 I'm on a large corner block and have a very large verge.  Have been parking my boat on the verge for the last 3 years with no issue, but recently I came home and found a parking ticket on the trailer.

On further research, the council fined me for parking an *un-attached* trailer in a *public place* or *throughfare*.  So they basically say that I am not allowed to park any trailer if it is not attached to a car.  This leads me to a difficult situation where I now need to park my car and boat on the street instead of having just the boat on my verge.

Has anyone else had to deal with this?  Any ideas how I could approach it?

 Councils do random audits at times, I got stung a couple of times up north for the same thing and also having a vehicle parked out the front of my own place (at least 2-3ft away from the verge) without plates. They went through the whole town and done others aswell.

I tried to fight it with City of Stirling where I had a small surfcat on the verge but it's not just the unattached trailer by-law they get you on but also parking in the same spot for a period of more than 24 hours. I was lucky enough to have a warning note with no fine though.

If you want to continue parking there it will be a combo of having to buy a rust bucket (although I assume it would still need to be registered) and roll the rig forward every 24 hrs and then back again the next 24 hrs. F&*&n ridiculous BS.

Agreed on little johnny's neighbour complaint comment. The ranger I spoke to confirmed that they don't go around specifically looking for parking breaches but are required to check it out if someone complains. If you can find out who complained you can park on the street in front of THEIR verge and so long as it's moved every 24hrs they can't do shit about it. Keep it up for a week and they'll give in to you parking back on your verge unattached.

 Since you’ve had it out there for the last 3 years , there’s a half a chance someone has whinged about it and sparked them into action .

Not sure which council your with but I would’ve thought a warning notice firstly would’ve been more appropriate to one of it’s ratepayers, I’ve had those when selling a boat or car on the verge before .
Good luck councils are typically somewhat anal about their little regulations .. ring your local member not that they’ll do anything , but it'll make you feel better paying out on them at least .

 If everyone in the street parked their truck and or caravans on the verge in your street would that be accepatble. We may not agree but the rule is there for a reason. If someone parked their car and boat in front of my house for a week it would have holes in it by the 2nd day.

A letter giving you notice and a time period to to make alternative arrangements should have been the way to go about it especially when it's been parked there for so long.

Like morgs said it's not uncommon for councils to randomly do this however a few years ago my council did a run around the streets and handed out letters asking for the trailer to be removed from the verge. It was for any trailer and luckily I only had to move it over a couple of meters and then it was in my property so all good.

And many council bylaws expressly prohibit parking on verges.....Canning and Gosnells both have the same regulations and recently have been enforcing them with a warning first then threatening to tow away

But NO..... if disputed unless they can demonstrate that the vehicle was unlocked ( and hence unsecured ) you should have cover however many boat policies do NOT cover loose contents and that can include sounders, GPS, fishing gear and the like

It is an insurers responsibility to show that the loss only occurred because of the action of parking it there....that is impossible for them to do so as it could equally have happened on the persons driveway !

A state law, also says you can't park within 6 metres of a corner, to aid in sight lines for people turning.

 

So maybe attached to a car or not they might be able to fine you?
