Watch this story evolve

A very interesting story is going to develop over the next couple of days, the subject of which has been discussed many many times on F/W.

The story is about just what can you do if you find some piece of human excrement stealing, or attempting to steal some of your property. On channel 7 news tonight there was a story about a person being caught trying to break into a residence and being detained by (I believe 3 men).

During the altercation to detain/stop the house breaker he sustained serious head injuries and as a result is in Perth Hospital.

One of the people who assisted in detaining the would be house breaker until the police arrived has been charged with GBH. That's the very basics of the story as I understand it.

Now, quite a few times people have had their property stolen and reported it on this forum and also insinuated just what they would like to do to the thief if they caught him in the act.

Basically the law (as I understand it) says that reasonable force may be used to stop/detain the thief if they are confronted/discovered breaking into your property.

It will be very interesting to see just what constitutes "reasonable force" and exactly just what happened when the person was confronted

 If one was to deal with an offender vigilante style justice then one would not want to be identified. If one does deliver the deserved justice to the offender and detains till police arrive then one would want a few "resisting arrest" wounds. 

 

I think it's bullshit myself that ol mates getting charged with GBH but as I said, if your dishing out a bit of self imposed justice then Don't Get Caught! Otherwise you end up facing criminal charges and the offender can then counter sue. And imagine there is not enough evidence for a conviction of the said offender... 

 

Our JustIce system is a farce.

Possibly we need "stand your ground" laws as in some US states, where you do not need to retreat from an intruder, to determine them as hostile.

A bit hard to determine what the story is ie : did the bloke charged with GBH actually live at the address ?

 With the benefit of hindsight in the event of accidently causing injury to a intruder it may well be better to not notify authorities and instead put your Winston Wolfe hat on ..

 If we get pulled over speeding, cop says if you werent speeding you wouldnt get a fine. So If you werent trying to steal peoples hard earnt belongings for a hit of smack you wouldnt need to spend the rest of your life as a vegetable. Leaving someone for dead isnt rite imo, letting them suffer in a bit of pain that will eventually heal to re think there actions im all for. Ive heard cops say it too i definately havent herd them say almost kill em then dump em.

 I'm not sure what the circumstances are in this matter uncle.  Just saying that if someone breaks into your house, you are allowed to defend yourself or other people with necessay reasonable force.  If you genuinely fear death or GBH to yourself or another, you have a legal defence if you cause death or GBH to the intruder.

if the person is on your property whilst commuting a crime. As long as you have taken reasonable steps to protect the general public. This means if the dog gets em before they break in, smash a window to prove a crime took place

 mate of mine had two rotties that were very protctive of him and his property , he had some indigous boys break in to his place in willage , and the mutts took to  them , cops called   turned up and and followed the trail of blood down the street untill they found them kackered sitting on the curb , dont worry about the dogs attacking them no different to one of our dogs chewing an offender up the coppers said , a month later he was hit with a court summons ,for using excesive force , yes got chucked out  but why oh why did he have to go through that process , compaint made by the offenders is my guess

 I heard today that the bloke recons he wasn't trying to break into the house and thought it was his new house.

He had apparently been out on the piss and caught a taxi home. The taxi however dropped the guy off in the wrong street and as this bloke had only just boaught the house got a bit lost and I guess thought it was his house.....must have been pretty pissed !!

The result is that one or more of the three has been charged with GBH ....just what the radio said today.

 Well you can thank the media for beating this one up. I can see why everyone is hot headed and on edge with this type of thing because we are all sick and tired of being thieved from and all the other shit crime to go with it. Who know's maybe more evolving for this story yet.

The way the story is now according to channel 7 news is briefly, guy is drunk gets dropped off at wrong address by taxi driver.

The guy who is drunk goes wondering around trying to find out just where the hell he is, a couple of guys acting too quick of the mark think he is attempting to break into a residence and one really gives the geographically confused drunk a terrible hiding.

Hmm that's the way I see the story ending.

This is not going to end good for a couple of people, one is in hospital and another is up on a GBH charge.
