my mate got broken into in willagee 2 nights ago his two rottys bailed the offender up and took a few chunks out of him , then Eddie gave him a few smacks and held him until the cops arrived , believe it or not eddie is being charged with assault

I live very close to willagee and have two dobermans and they would eat anyone who jumped into "there" back yard. And if I caught them they would also be getting slapped around.
Its just human nature for a dog and man to defend his home.

I'm no lawyer...
...but as I understand it, if someone breaks into a home and does not threaten or attack the resident, and the resident gives him/her a hiding (or even just a "few smacks"), then it's an assault charge against the resident. The offender would get done for B & E.

Or there is a strong possibility the dogs might be put down however if IN the home there is no issue whatever. We had that situation about ten years ago and the police officer specifically recorded that the dark skinned gentleman was inside the lockable patio when bitten just to make sure !

Detaining some one/citizens arrest
It sucks there is no other way to describe the law as far as dealing with the bad guy In a past age when law and common sense had some relevance the situation was resolved thus, shithead (offender) was caught breaking in, owner of property belted the shit out of offender then called cops. Cops arrived gave offender (shithead) a bit of a slapping and advised him of his options which where, crawl home and don't let me see you again or you will find out what big trouble (flogging) is really like. run away from home and make sure you are not found. Go home tell your parents what has happened and receive a flogging from your parents as well.
Result no more house breaking from that particular shithead sorry offender.
Problem solved.
Now,
Police strongly advise people not to even think about doing it if it could put you or other people in danger. You aren't entitled to search the detainee or their property. You can use only "reasonable force" to detain them – force that is "reasonable" to the situation.
There's also a catch in the law. You can't detain someone too violently as you have a "duty of care" to the person you detain. You also have a "duty of care" if you decide to release a person before police arrive. A juvenile should only be released into the care of a parent, guardian or police.
Remember - using too much force could result in the detainee charging you with assault or seeking civil damages. Finally, if the person you 'arrested' is released without charge, they might be able to sue you for false imprisonment. Self-defence and Good Samaritan laws may be a defence, but you can't play cop and investigate yourself.

I read that as, if he gets "done" then he has been convicted of the offence...being charged means he has to front up to a magistrate/judge and plead his case. He can be charged yet still be found not guilty. He'll get off.
