todays news is premier marky mgowan is demoting mr tinley the current fisheries minister
he has been given notice he will be moved on
also interesting to note the central northern seat was lost by nationals vince cattania and won by labor , that take sin shark bay ,,so the locals must have been swayed a little by the state wide reductions on demersals , they got there way and likley many voted accordingly ,,,.. mr tinleye rewards is to be demoted
bit or irony in that for him giving them locals what they wanted , helping to win the seat and then get the chop
interesting to see who the new minister is
lets hope he is not too green leaning and does actually fish

That's not good news. Peter Tinley has done some very good things as fisheries minister, including clearing up the ambiguity of divers having 5 mins to check their crays on deck, just to name a quick 1.
I wonder if it has anything to do with Ben Wyatt retiring?

There was never any ambiguity, divers don't have 5 minutes to check their catch for undersize/tarspot and they never have. They have 5 minutes to tail clip them, if a diver surfaces and has an undersize or a tarspot in their catch bag they are committing an offence.

there was ambiguity, it is not specifically listed in Legislation but was interpretted differently a few years back.
There is nothing in legislation "if a diver surfaces..."

straight from the WA fisheries cray brochure:
"Fisheries Officers in normal circumstances allow five minutes from when a diver returns to the vessel for divers to sort, recheck for any totally protected lobster and tail clip their catch (see page 14), before undertaking their inspection."

this was bought in after the Bret Carter debacle.
its comments like yours Vic, that create further ambuguity. familiarise yourself with the rules, and think before posting something you know little or nothing about.

A diver surfacing is deemed
A diver surfacing is deemed to have taken the crays in their catch bag, you are meant to size and check them as you snare or grab them before putting them in your catch bag.
There's case law as to what taken means, comes down to whether a cray is free to come and go and that doesn't include being inside a catch bag.

Cheers for the PM Vic, but a constant problem that pops up as we have seen already, is Fisheries getting ahead of themselves and "making it up as they go".
I have seen this personally, where a FO on the ground (or mid level) makes a prosecution decision on the run following which upper management with unlimited budgets take upon themselves to defend to the death.
And we all know the shortcomings of our "justice system" where money buys results and it is simply luck whether you get a sympathetic judge.
Fisheries, while they have some discretion and leeway, are not lawmakers, they are upholders.
And at the end of it all, they forgot that it was all about protecting the resource where it needed protecting, not because they locked themselves in and burned their standing among law abiding fisho's, all for nothing.
It would be good to submit a FOI request for how much they spent on Bret Carter, but I have no doubt the answer would be "it is not possible to quantify this information and is not in the public interest".

Labor has never forgotten about Vince jumping ship and joining the National Party years back and since then there has only been minimal moneys invested by the State Govt in the North West electorate compare to other regions, so if he loses then things up there may change like support for fixing the One Mile Jetty that is on the verge of falling down
