whether its in your car home or garden chained up or not warning signs or verbal warnings, if you have a dog that bites someone you are in the shit even if it is a sook if it bites your in trouble

more to the point why did he need to put his arm in the car?

So..

Tue, 2014-07-15 06:51

...the Jack Russell deal fell through? And you went and got a savage dog! Really, if it bites anyone under any circumstances, it's NOT a "sook". A sooky dog would've licked the cop instead.

And yeah, why, to repeat fishy finger's question, did he need to put his hand in the car?

I'm telling ya Pete, all this hanging around boat ramps is starting to raise a few eyebrows by the sounds of it...

beautiful German Shepard (RIP Sheba)was also a sook, kids could climb over her, she towed kids in the pram, did everything with my kids.  But if you put a finger in the car, goodbye finger and especially if the kids were in the car.  Always worried that if I had a accident would Sheba let anybody in to rescue us as she was very protective of her family.

Petermac I know your pain and  you warned the Policeman so think their is cause for a appeal.

The answer to your question is yes, from the dealings that I have had with them. I'm pretty sure they don't do an IQ test to join the force! However they are a needed service to the community.

Road Traffic Act requires animals to be adequately secured

Tue, 2014-07-15 12:14

And if adequately secured how did it get to the drivers side window ?

pretty much what the owner of a dog that attacked my 2 resulting in one of them ending up at the vet last week said. Sadly rightly or wrongly in your case it's a $400 fine for not having proper control or potentially a summons depending on the mood of the moment.  Only good thing for you is dogs fall under the dog act which is a council thing not a police matter so you may hear no more.

Bit off topic here but, if two dog owners walk past each other in a public place with all dogs off leads and the dogs have a scrap resulting in an injury, can the owner of the dog that came out on top be in the shit?

Quote from dog control regs WA.

Tue, 2014-07-15 17:16

When in any public place in Western Australia, dogs must be tethered or on a leash unless the place is a designated “Dog Exercise Area”. Even when in a dog exercise area, owners are still held fully responsible for the control and behaviour of their animals. If a dog is found to be wandering at large or being walked by its owner off a leash in a public place.
So basicly both owners will be in the shit.

Simple answer .....yes but your homeowners liability policy

Tue, 2014-07-15 17:12

Might and I stress might pick up any legal award against you for damages and costs but not fines......have seen several such cases but each policy is different so you need to read carefully.

Statistically would you believe golden labs are more likely to bite than shepards or bull terriers......strange but as of two years ago true

not good

Tue, 2014-07-15 23:43

don't feel good about it at all , but look at this way if he was laying on the back seat and some one tried to pinch my car would I be in strife if he latched on or if I was in a road rage incident and latched on ? yes he shouldn't have bitten the cop but he was clearly warned and I would have happily stepped out of the car to do the test but for some reason they want you to stay in your car , personally think if any one gets in your personal space they are asking for trouble if that cop had just let me get out of the car he wouldn't have got bitten

Dogs shouldnt bite any one

Tue, 2014-07-15 20:45

Dogs shouldnt bite any one full stop. If they do its your failure to train them properly. The cop was just doing his job its got nothing to do with him being dumb.

Gotta ask the question Peter. Who is the dumb one? The cop for doing his job or you for not training your dog properly. If you knew it was going to bite the cops hand when he stuck it in the window then you shouldnt own the dog because you obviously cant train it properly.

 Jayce- my dog bites, and

Tue, 2014-07-15 22:29

Jayce- my dog bites, and I've trained him to bite, I have signs up around my property saying I have a dangerous dog on my property, he also has to wear a 'dangerous dog ' collar at all times- it's hi-vis/reflective yellow and red. He also has to be secured behind out 6foot fence and all gates are to have padlocks on them,

cops decided to not read these signs and decided to jump the fence instead off knocking because I not knowingly bought a stolen outboard from gumtree, my dog did his job and mauled the copper drew blood and he needed stitches,

I gave him the biggest bone I could find at the butchers and told the copper he was a dumb f&$;Ker and that was that.

And that ladies and gentlemen is where dogs get their bad reputation from.

And incase you were wondering the signs dont mean jack. The cop could have shot the dog on the spot and he would have been in the right. Having signs and all that up doesnt make it acceptable it just means you acknowledge the fact you have a dangerous dog and dont care what he does.

The ranger told me if you have signs up saying dangerous dogs you are not liable for any damage done with the perimiter of your fence

I don't think that's entirely

Wed, 2014-07-16 08:49

I don't think that's entirely correct actually just from my own experience with the same issue

I have the appropriate warning signage at my property, a perimeter fence with a dog patrolling his domain. I was advised despite this someone if someone entered the property & good ol' Boxer Ed' gave them a quick one, two I was up shit creek. I put in a lovely bell to alert us of visitors right next to the gate & sign but despite this if some halfwit decides not to use it I am possibly / potentially liable.

All that aside a fair few years ago now back in Perth missus had potential violent home invasion with an intruder, last seen scrambling over the fence with the dog attached to his arse...

In your 'speak', what your saying is the coppers came to do a search warrant on your house because you had some stolen gear and went in through the back and front and one of your dogs went one of the coppers.

wow, bet you showed them........
