Once a diver has 'TAKEN' a lobster can he 'UNTAKE' it?

This is a question I have been pondering for some time now after following the progress of the Bret Carter case. Evidence from the court case stated that the Fisheries interpretation was that a lobster is 'TAKEN' when a diver places that lobster within a catch bag.

"... Fisheries Officer Demir stated that her understanding of the legal obligation was that a fisherman must only 'take' eight rock lobsters daily. The officer confirmed in her opinion, the rock lobster is 'taken' when 'you have captured the animal underwater and placed it into the catch bag ..."

So can a lobster become 'UNTAKEN'? My first thought was no based upon the Fisheries view that the act of TAKING a lobster is complete once that lobster is placed in a catch bag. That would suggest to me that once that act of TAKING is complete that act becomes irreversible as it is in the past and any subsequent action such as releasing a TAKEN lobster doesn't cancel or negate the original 'TAKING'.

Esperance for kids??

 Hey guys,

Heading down to Esperance for a week and although I’m leaving mine and the missus gear at home I’m considering taking the kids gear if it’s worth it?? I have been told the old tanker jetty is now closed but is there anywhere else around the town worth dropping some light gear??

Its one of the few coastal towns in WA I’ve never been to, so I’m shooting completely blind on this one.

Cheers fellas.

Favourite soft plastics

 Hi guys

I have started to use soft plastics and just want some advice on what your favourite soft plastics are for inshore fishing around 10 metres and what size jig heads you use in that depth l will mainly be targeting pink snapper King George whiting skippy and all other inshore fish.

Thanks

Cray pots ( hope not many out there)

This wind will move them miles regardless of weight in them. Going to be many stuck , berried or missing.

Changes to crayfish rules

Well, after the debacle with Bret Carter, I'm surprised by the rule changes that fisheries went with sensible changes.

As a diver your now have 5 minutes to sort your catch on board (but can't take berried or tar spot up)

Setose females can now be taken (not berriesd or tarspot)

No female maximum size limit (from last year)

Simplification of pot rules

You can keep cray tails with shell on at your residence

good weekend

went to rotto for the weekend took friday off and came back sunday what a trip we got there around 11am friday and fished the north side of the island drifting in around 10-20m we picked up a few small but sized dhueys 55 - 65cm then the missus landed a nice baldie and i got this kg all fish where released we then went back to our mooring at geordie bay where we got the bbq going few beers some steaks and a squid jig under a float out after a bout 5 mins the rod buckled over on a decent calamari got about 3 more of them before the sun went down bait for tommorow sorted!

the sun went down and it was lovely kicking back and then.....the storm hit ! all night was bloody rough wasnt a good nights sleep at all haha the next day we went out fishing no dhueys around but plenty of yellow tail kings we spent hours following them chucking stick baits chucking bait everything at them i even chucked the missus at em but they were just not hungry.

drifted a bit more with no luck so went to thompson bay for a bite to eat and relaxed for the rest of the night

on sunday we thought we would  try get a few fillets to take home we started around the west end of rotto and worked direction bank all the way until mindarie with not one good fish hahah had a whale come about 1 metre from the boat and gave us a little show so that was a nice suprise.

all in all was a really good weekend and cant wait to do the rotto trip again fads next time i think though.

Trailer drawbar extension

Anyone on here got one made up or bought from somewhere? Looking for a foldable add on type for my 4.55 stessco to beach launch

Sounder image

Went out for a last fish before the ban yesterday. I was mostly interested in learning to drive the EVO3. We found quite some good fish shows but the bite was quiet most of the day. Ended up with a good pinky, small dhu a small grey band and a few large skippy. So the lads were happy.

I took this shot west of Rottnest. Anybody know what this could be. I'm thinking bait fish because we didn't get a bite..

Right is totalscan at 83hz chirp

Tailor - Where to catch south of the river?

hey folks

Wondering if anyone has any tips on where to find Tailor south of the river. I've tried Mewstones the other day around mid morning using a Gillies white bait metal lure but no luck there.

cheers

Canal Rocks boat ramp.

There are plans afoot for the Department of Parks and Wildlife to close canal rocks boat ramp because they claim it is too dangerous for boaties to use. This is the only boat ramp that Marine rescue can use on the west coast and have strongly opposed the closure so DPaw now say that it could be gated so that you would need a key to use it. A lot of recfisho's use this ramp in the summer time and us rec fisho's need to come out strongly and object also to the closure. I suspect it's got nothing to do with safety but more to do with protecting the Marine parks. Don't sit back and be quiet on this issue or else we will lose it.

Floater Rig

Could I please get some opinions, and maybe criticism, on the rig I use with a float?

That is just a normal line (not a leader) running down from the float, connected to the two trace leaders, one halfway down and one at the bottom and the smallest sinker possible to keep it down

First day of cray season - freediving

So we were expecting crystal clear water after 2 days of low wind and low swell. Boy were we wrong. The ocean was very dirty and very surgey. Inshore visability was about 3-4metres. Thoughts of a lurking great white was in the back of my mind all day in light of recent sightings. Freediving was hard work being bashed around the ledges and caves.

We dove 3 spots, all west of Garden Island, crays were found shelting from the surge either deep under ledges, on the leeside of the surge (facing east) or deep in caves. Depths ranged from 14m, 6m and 4m.

No shed shells, no double shells or white crays yet.

16 crays, 2 freedivers and first bagout on my mates new dingy.

Last run before the ban

Towed the boat up to Lancelin yesterday morning for the last trip before the ban starts , first time launching from there and first beach launch for the new crusher, beautiful weather lots of fish and a few beverages as it was my birthday! Great day,  bagged out by 9.00 (6-8kg dhu and 2 hooter baldies) without a single GPS point ! Perfect.

Alvey reel

 Hey

and was looking at Alvey reels. We did used to use these when I was a kid in

Brisbane, think that is all they use. But it has been a while, does anyone use these and

recommend them?

Offshore advice

 Hi Guys

I am reletively new to offshore fishing and looking to get started into some pinkies and sambos and other demersal species l will mainly just be drifting around with paternoster style rigs and maybe dropping some soft plastics down. What type of spin reel and rod would you recommend for this type of fishing my budget is $200 not including line what type of line is better for this type of fishing? Also l want to stay light as possible but it can still handle sambos?

Thanks

Tailor run

Popped out with mrs for tailor fish last night was

out for bout two hours bait casting mulies was a little

too calm for my liking! Got a little berly goin I know

the bronzies can be around this time a year and have

picked up a fair few in seasons by ! But far out count

was 3 tailor which weren't anything speacial but 4

sharks kept us busy and fairly light gear made it

interesting.. think I'll not go so heavy on the berly

next trip. Cheers pirate

Geo Bay Magic

Headed out to the 30s off Meelup to get some big sandies but got plagued by small flatties but were greated by several whales playing all around us which enchanted the Mrs and the kids.
Managed to jig a squid that followed up a flattie and headed inshore for a swim where I had a flick with a minnow only to get monstered by a huge school of 35cm+ salmon on my 4lb line on my 1000 reel and 1-2kg rod. Brilliant fun. Dropped the crew off to chase some more squid and ended up with a baby I plan to drop down tomoz.

Powerdive or similar hookah hire

Was dead keen to hire a Powerdive for an upcoming weekend at Rotto but Powerdive in Mosman Park no longer hire them. Anyone know any other places could hire one or a similar device to float along surface?

Not so keen on lugging several scuba kits over for shallow 5m dives. (tried free diving last years trip)

Any tips would be appreciated. Unable to justify the purchase of one as will not get enough use.

Dampier bottom fishing

Recently moved to Karratha and purchased a 5.5M tinnie. Getting some Spaniards and spearing some fish but not having much luck with the bottom fishing.

Any tips for spots without having to go 60-70km's offshore. Have been mainly fishing the gas pipeline without much success.
